Dear [Regulated Party Contact Person]:


Enclosed is a Memorandum of Understanding (MOU) agreed upon by the Minnesota Pollution Control Agency (MPCA), City of Oronoco (City), and Olmsted County (County). The intent of this MOU, is to provide the residents within Sewer District B additional time beyond the County’s 10-month compliance period, not to exceed 5 years, to upgrade or replace septic systems that are identified as Imminent Public Health Threat (IPHT) and Failing to Protect Ground Water (FTPGW) while the City of Oronoco evaluates the possibility of constructing a publically owned and operated collection and treatment system.  


During the effective period of the MOU, the County is to continue to follow the inspection protocol that is outlined in their ordinance.   If a septic system is found to be an IPHT or a FTPGW and the inspection falls within the five year timeframe after the MOU is signed by all parties, then the County would not enforce the 10-month timeframe and any associated penalties outlined in the ordinance on a homeowner that resides in Sewer District B.  Instead, the County would notify the homeowner of the non-compliance, the provisions of this MOU, and how it impacts the homeowner.  If the inspection falls outside the timeframe of the MOU, then the inspection and follow-up enforcement would proceed as stated in the ordinance.


The first section of the MOU identifies all the parties that are a part of the MOU.   The second section describes how all the parties will work together to upgrade, replace or eliminate all septic systems that are identified as IPHT or FTPGW.  The third section describes the agreement between all the parties involved and the time frames for each activity.  The fourth section describes what to do if there is any modifications, any extensions needed or how to handle a conflict between any of the parties.
